1. Agreement to Terms
By accessing or placing an order through our WooCommerce-powered website (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before making a purchase. If you do not agree with any part of these Terms, you should not use the Site or place an order.
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and us ("Shop," "we," "our," or "us"). We reserve the right to update or modify these Terms at any time without prior notice.
2. Products and Categories
Our Shop offers four categories of products, each governed by distinct policies described in these Terms:
- Original Art — Original paintings, prints, drawings, photography, digital art, and other fine art works created by artists.
- Handmade One-of-a-Kind Goods — Individually crafted items including ceramics, jewelry, textiles, woodwork, and other artisan goods made by hand.
- Merchandise ("Merch") — Branded or printed goods including apparel, accessories, stationery, and other manufactured items.
- Vintage Goods — Pre-owned or antique items that are at least 20 years old, sourced and curated for resale.
Product descriptions, images, and listings are provided in good faith. Because many of our items are one-of-a-kind or hand-crafted, slight variations in color, texture, size, or finish from photographs are inherent to the nature of these goods and do not constitute defects.
3. Pricing and Payment
All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors at any time. If a pricing error is discovered after your order is placed, we will notify you and give you the option to confirm your order at the correct price or cancel for a full refund.
We accept payment via all major credit and debit cards, PayPal, and any other payment methods displayed at checkout. Payment must be received in full before your order is processed and shipped. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method.
Applicable sales tax will be added to orders where required by law based on your shipping address.
4. Order Processing and Confirmation
Placing an item in your cart does not reserve it. An order is not confirmed until you receive an order confirmation email from us. We reserve the right to cancel or refuse any order at our discretion, including but not limited to cases of suspected fraud, payment failure, or item unavailability.
Because many of our items are one-of-a-kind, inventory is not guaranteed. If an item you ordered becomes unavailable, we will notify you promptly and issue a full refund.
5. Shipping and Delivery
We ship to addresses within the United States and select international destinations. Shipping rates and estimated delivery times are displayed at checkout. All shipping timelines are estimates only and are not guaranteed.
Once an order is handed to the carrier, risk of loss and title pass to you. We are not responsible for delays, losses, or damages caused by the shipping carrier. We strongly recommend purchasing shipping insurance for high-value orders. Please contact us if your package arrives damaged or is reported lost by the carrier — we will do our best to assist, though outcomes are subject to carrier policies.
For fragile, oversized, or high-value items (including original art), special packaging and handling fees may apply and will be disclosed at checkout.
6. Return and Refund Policy
Our return and refund policy varies by product category. Please review the applicable policy for your purchase carefully before completing your order.
6.1 All Sales Final — Art, Handmade One-of-a-Kind Goods, and Merchandise
ALL SALES ARE FINAL on the following product categories:
- Original Art
- Art Prints
- Handmade One-of-a-Kind Goods
- Merchandise (Merch)
We do not accept returns, exchanges, or cancellations on these items once an order has been placed and payment confirmed. This policy exists because these products are unique, handmade, or made-to-order in nature and cannot be restocked or resold once purchased.
Exceptions are made only in the following limited circumstances:
- The item arrives materially damaged due to our packaging or a manufacturing defect (photographic evidence required within 72 hours of delivery).
- You received the wrong item due to our fulfillment error.
In such cases, please contact us within 72 hours of delivery with your order number and clear photographs of the issue. We reserve the right to determine the appropriate remedy, which may include a replacement, store credit, or refund at our sole discretion. Color variations, minor size discrepancies consistent with handmade production, and aesthetic preferences do not qualify for exceptions under this policy.
6.2 Vintage Goods — 30-Day Return Policy
We accept returns on Vintage Goods within 30 days of the delivery date, subject to the conditions below.
To be eligible for a return, the item must be:
- Returned within 30 calendar days of the date of delivery as confirmed by carrier tracking.
- In the same condition as received — unworn, unused, and unaltered.
- Accompanied by the original packaging where reasonably possible.
- Accompanied by proof of purchase (order number or confirmation email).
To initiate a return, contact us at [your contact email] with your order number and reason for return. We will provide a Return Merchandise Authorization (RMA) number and return shipping instructions. Returns sent without an RMA number will not be accepted.
Return shipping costs are the responsibility of the customer unless the return is due to our error. We recommend using a trackable shipping method, as we are not responsible for items lost or damaged in return transit.
Once we receive and inspect the returned item, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 7–10 business days. Original shipping charges are non-refundable.
The following vintage items are not eligible for return even within the 30-day window:
- Items explicitly marked "As-Is" or "Final Sale" in the listing.
- Items that show evidence of use, damage, or alteration after delivery.
- Items returned without prior authorization (no RMA).
7. Order Cancellations
Due to the nature of our products, cancellation requests are handled as follows:
- Art, Handmade One-of-a-Kind Goods, and Merchandise: Orders cannot be cancelled once placed and payment is confirmed.
- Vintage Goods: Cancellation requests submitted within 24 hours of order placement may be honored at our discretion, provided the item has not yet shipped. Contact us immediately at [your contact email] to request a cancellation.
If an order cannot be cancelled per the above policy, the standard return policy for the respective product category will apply.
8. Intellectual Property
All content on this Site, including but not limited to artwork images, product photographs, descriptions, logos, and graphics, is the property of our Shop or the respective artists and is protected by applicable copyright and intellectual property laws.
Purchase of a physical art or handmade product does not transfer copyright or any reproduction rights to the buyer. You may not reproduce, distribute, publicly display, or create derivative works from any item or content on this Site without the express written permission of the copyright holder.
9. Disclaimers and Limitation of Liability
Products are provided "as is" and "as available." We make no warranties, express or implied, regarding merchantability or fitness for a particular purpose beyond what is explicitly stated in a product listing.
To the fullest extent permitted by law, our total liability to you for any claims arising out of or relating to these Terms or your purchase shall not exceed the amount you paid for the specific item giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.
10. Privacy Policy
Your personal information is collected and used in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in our Privacy Policy. We use WooCommerce and WordPress to process transactions, and your data may be processed by their respective platforms in accordance with their privacy policies.
11. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in Atlanta, Georgia in accordance with the rules of the American Arbitration Association.
